June 26, 2026 For these reasons, the court, after deliberating according to the law, ruling in the appeal case, upholds the default requested at the hearing on Tuesday, May 13, 2025, against Mrs. Magna Demerzil for not appearing or reappearing at the hearing today, states that the Saint Michel du Sud Justice of the Peace Court has jurisdiction to hear this eviction action according to Article 84 of the Decree of August 22, 1995, on the Organization of the Judiciary, orders the eviction from the applicant’s property, grants provisional enforcement of the judgment, and finally orders the cited party to pay the applicant the sum of eighteen thousand gourdes (18,000) as damages for material and moral harm caused to the plaintiff, with costs and expenses, all in accordance with Articles 49 of the Civil Procedure Code, Pierre Marie Michel, Article 84 of the Decree of August 22, 1995, relating to the organization of courts, and 1168, 1169.of the Haitian civil code.
